It is fair to say that to most buyers, closing on property should not present problems if you have the help of a good Real Estate Attorney. Remember that even thought a notary is supossed to supervise all the work, he will not necessarily give you all the information nor he will benefit you just because you, as the buyer, pay his fees.
Do not trust anything your Real Estate agent promises you if he refuses to put it in writing. You must understand that the lack of Real Estate Regulations makes it very easy for anyone to promote the sale of property even though that property is sometimes nontransferable. It will be up to you to seek a professional and not be defrauded.Foreigners cannot acquire title to Ejido Land. When looking to buy property make sure it is deeded. A title search will let you know if there are any liens on the property, the name(s) of legal owner(s), property taxes due, etc. You or your attorney need to make sure that all matters regarding personnel working at the property be disclosed and settled before buying. In México, -domestic- labor obligations are not necessarily established between the employer and the employee, but rather from the place of work (fuente de trabajo) and the employee. You will be responsible for unpaid wages and other employee benefits.
There are some cases when you can offer to buy a deed-less property, such as in pre-construction. In this case, have a Real Estate Attorney review the contract, the developer’s background, construction licenses, insurance, city permits, etc., I strongly suggest the use of an escrow account. The developer shall disclose all information necessary to you.
